Overview
This Terms of Service Agreement ("Agreement") is entered into by and between Minder InfoTech Private Limited (operating as "Hosting Minder", hereinafter "we", "us", or "our") and you, the user or customer ("you", "your", "User", "Subscriber", or "Customer"), and is made effective as of the date of your electronic acceptance.
This Agreement sets forth the general terms and conditions governing your use of Hosting Minder's services ("Services") purchased or accessed through our website ("Site"). It is in addition to — and not in lieu of — any specific terms that apply to the particular services you subscribe to.
Minder InfoTech Private Limited, in its sole and absolute discretion, may modify this Agreement at any time. Modifications shall be effective immediately upon being posted to this Site. Continued use of our Site or Services after such changes constitutes your acceptance of the revised Agreement. Other terms shall be interpreted in accordance with the Information Technology Act, 2000 and applicable Indian laws.
Eligibility & Authority
Our Site and Services are available only to users who can form legally binding contracts under applicable law. By using our Site or Services, you represent and warrant that you are:
- At least 18 years of age, and/or
- Otherwise recognised as capable of forming legally binding contracts under applicable law.
If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind such entity. If Hosting Minder finds that you do not have such authority, you shall be personally responsible for all obligations under this Agreement, including payment obligations.
Accounts
To access certain features or purchase Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate.
- Keep your login credentials, passwords, and payment methods secure and confidential.
- Accept full responsibility for all activities that occur under your account, whether authorised by you or not.
- Notify us immediately of any unauthorised use of your account or any other security breach.
For security, we recommend changing your password at least once every six (6) months. Hosting Minder reserves the right to suspend or terminate accounts where information is found to be untrue, inaccurate, out-of-date, or incomplete.

Hosting Minder, operated by Minder InfoTech Private Limited, provides web hosting and related technology services, including but not limited to:
- Shared Web Hosting
- VPS (Virtual Private Server) Hosting
- Dedicated Server Hosting
- Cloud Hosting Solutions
- Domain Name Registration & Management
- SSL Certificate Provisioning
- Email Hosting Services
- Website Migration & Transfer Services
We reserve the right to modify, suspend, or discontinue any Service at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
Payment & Billing
By purchasing Services, you agree to pay all applicable fees as described on our Site. The following payment terms apply:
Subscription & Renewal
- Services are billed in advance on a monthly, quarterly, or annual basis as selected during purchase.
- Unless cancelled prior to the renewal date, subscriptions renew automatically at the then-current rates.
- You authorise Hosting Minder to charge your selected payment method upon renewal.
Price Changes
- Hosting Minder reserves the right to change pricing for any Service at any time.
- Price changes will be communicated to customers via email and/or posted on our Site with reasonable notice.
- Continued use of Services after a price change constitutes acceptance of the new pricing.
Taxes
All fees are exclusive of applicable taxes. You are responsible for paying all taxes, duties, and levies associated with your purchase, including GST as applicable under Indian law.
Refund Policy
Hosting Minder offers a 30-day money-back guarantee for eligible shared hosting plans. The following conditions apply:
- Refund requests must be submitted within 30 days of the initial purchase date.
- The money-back guarantee applies to shared hosting plans only. VPS, Dedicated Servers, Cloud plans, domain registrations, and SSL certificates are non-refundable.
- Setup fees, if any, are non-refundable.
- Refunds are processed to the original payment method within 7–10 business days.
- Accounts terminated for violation of our Acceptable Use Policy are not eligible for refunds.
Acceptable Use Policy
You agree to use our Services only for lawful purposes and in compliance with all applicable laws and regulations. The following activities are strictly prohibited:
Prohibited Content
- Hosting, transmitting, or distributing unlawful, harmful, threatening, abusive, defamatory, or obscene content.
- Content that infringes any intellectual property or proprietary rights of third parties.
- Child sexual abuse material (CSAM) or any content that exploits minors.
- Spam, unsolicited commercial email, or bulk messaging campaigns.
Prohibited Activities
- Engaging in hacking, phishing, or any other unauthorised access to computer systems.
- Distributing malware, viruses, ransomware, or other harmful software.
- Operating cryptocurrency mining operations without prior written consent.
- Conducting Distributed Denial of Service (DDoS) attacks or any attack against network infrastructure.
- Attempting to circumvent any security measures or access controls.
- Reselling or subletting server resources without authorisation.
Intellectual Property
All content, software, technology, trademarks, service marks, logos, and trade names displayed on the Hosting Minder website are the proprietary property of Minder InfoTech Private Limited or its licensors, and are protected by Indian and international intellectual property laws.
- You may not reproduce, distribute, modify, or create derivative works of any content from this Site without prior written consent.
- The Hosting Minder name, logo, and related marks are trademarks of Minder InfoTech Private Limited.
- Any feedback, suggestions, or ideas you provide to us may be used by Hosting Minder without obligation or compensation to you.
Your Content
You retain all intellectual property rights in the content you host with us. By uploading content to our servers, you grant Minder InfoTech Private Limited a limited, non-exclusive licence to host and display such content solely for the purpose of providing the Services.

Minder InfoTech Private Limited is committed to protecting your personal information. Our Privacy Policy describes in detail:

Uptime & Service Level Agreement (SLA)
Hosting Minder strives to maintain a high level of availability for all hosted services. Our uptime commitment is as follows:
- Shared Hosting: 99.9% uptime guarantee per calendar month.
- VPS & Cloud Hosting: 99.95% uptime guarantee per calendar month.
- Dedicated Servers: 99.99% uptime guarantee per calendar month.
Scheduled Maintenance
Planned maintenance windows are excluded from uptime calculations. We will endeavour to provide at least 24 hours' advance notice for scheduled maintenance that may affect your services.
SLA Credits
In the event that we fail to meet the stated uptime guarantee (excluding events of force majeure, scheduled maintenance, or customer-caused outages), you may be eligible for a service credit. Credits must be requested within 30 days of the incident by contacting our support team.
Limitation of Liability
To the maximum extent permitted by applicable law, Minder InfoTech Private Limited, its directors, officers, employees, agents, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or business opportunities.
- Damages arising from unauthorised access to or alteration of your transmissions or data.
- Any service interruption, delay, or failure beyond our reasonable control.
- Any damages arising from third-party software, services, or links accessed through our platform.
In no event shall our total aggregate liability to you exceed the total amount paid by you to Hosting Minder in the three (3) months immediately preceding the event giving rise to the claim.
Termination
By You
You may cancel your account and terminate Services at any time by contacting our billing support team. Cancellations take effect at the end of the current billing cycle unless an immediate cancellation is requested.
By Hosting Minder
Minder InfoTech Private Limited reserves the right to suspend or terminate your account and access to Services, at any time and with or without notice, for:
- Violation of these Terms or our Acceptable Use Policy.
- Non-payment of fees or chargebacks.
- Engaging in fraudulent or illegal activities.
- Actions that may harm Hosting Minder, its infrastructure, or other customers.
- Any other reason at our sole and absolute discretion.
Effect of Termination
Upon termination, your right to access the Services ceases immediately. We may delete your data and content from our servers. It is your sole responsibility to maintain backups of all hosted data.
Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Jurisdiction
Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
Dispute Resolution
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days. If the dispute cannot be resolved through negotiation, either party may seek legal recourse through the appropriate courts.
Changes to Terms
Minder InfoTech Private Limited reserves the right to revise these Terms & Conditions at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page.
- Notify registered customers via email for material changes.
- Post a notice on our website prior to the changes taking effect.
Your continued use of the Services after any such modifications constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must cease using the Services and contact us to cancel your account.
